DominiqueEllenDunne(November23,1959–November4,1982)wasanAmericanactress.BornandraisedinSantaMonica,California,DunnestudiedactingatMiltonKatselas'Workshop,wheresheappearedinstageproductions.Shemadeheron-screendebutwiththetelevisionfilmDiaryofaTeenageHitchhiker,andthereafterplayedtherecurringrolesofEricaonthedramaseriesFamily(1980),andPaulinaBornsteinonthecomedyseriesBreakingAway(1980–1981).Dunne'sbreakthroughcamewiththestarringroleofDanaFreelinginthehorrorfilmPoltergeist(1982),establishingherasahorroricon.ShewentontoheadlinethewesternfilmTheShadowRiders(1982),andportrayAmyKentonthecrimeseriesCHiPs(1982).Beforehermurder,DunnewascastintheminiseriesV(1983);however,shediedmidwaythroughfilming,andwasreplacedbyBlairTefkin.OnOctober30,1982,Dunnewasstrangledbyherex-boyfriend,JohnThomasSweeney,duringanargumentonthedrivewayofherWestHollywoodhomeandfellintoacoma,dyingfivedayslateronNovember4,1982.Inacourtcasewhichgainedsignificantmediacoverage,SweeneywasconvictedofvoluntarymanslaughterinDunne'sdeath,andservedthreeandahalfyearsinprison.LifeandcareerChildhood,educationandfamilyDunnewasborninSantaMonica,California,theyoungestchildofEllenBeatriz"Lenny"(néeGriffin),aranchingheiress,andDominickDunne,awriter,producer,andactor.DunnehadIrishandMexicanancestry,herfatherwasbornandraisedinanIrishCatholicfamilywithhermaternalgrandfatheranIrish-AmericanandhermaternalgrandmotheraMexican-AmericanwhowasfromSonora,Mexico.Dunnehadtwoolderbrothers,Alexander"Alex"andGriffinDunne,whoisanactoranddirector.ShewasalsothenieceofmarriednovelistsJohnGregoryDunneandJoanDidion.HergodparentswereMariaCooper-Janis,daughterofactorsGaryCooperandVeronica"Rocky"Cooper,andproducerMartinManulis.Herparentsdivorcedin1967.DunneattendedHarvard-WestlakeSchoolinLosAngeles,TaftSchoolinWatertown,Connecticut,andFountainValleySchoolinFountain,Colorado.Aftergraduation,shespentayearinFlorence,Italy,whereshelearnedItalian.ShestudiedactingatMiltonKatselas'Workshopandappearedinvariousstageproductions,includingWestSideStory,TheMousetrap,andMyThreeAngels.ActingcareerDunne'sfirstrolewasinthe1979televisionfilm,DiaryofaTeenageHitchhiker.Shethengotsupportingrolesinepisodesofpopular1980stelevisionseries,suchasLouGrant,Family,HarttoHart,andFame.Dunnealsohadarecurringroleonthecomedy-dramatelevisionseries,BreakingAway,andshealsoappearedinseveralothertelevisionfilms.Afterhertelevisionappearances,in1981,DunnewascastinthesupernaturalhorrorfilmPoltergeistinthemainroleofDanaFreeling,theteenageddaughterofacouplewhosefamilyisterrorizedbymalevolentghosts.ThefilmwasproducedbyStevenSpielberganddirectedbyTobeHooper,andservedasherfeaturefilmdebut.Poltergeistwastheatricallyreleasedin1982,whichmarksbothherfirststarringroleandheronlyappearanceinatheatricalfeature.Itwentontobecomeacriticalandcommercialsuccess,becomingtheeighth-highest-grossingfilmof1982,andsinceitsreleaseithasacquiredacultfollowing.Shewassettoreprisetheroleinthefollowinginstallmentsofthefranchise,butshediedbeforeproductionbeganonthesequels;PoltergeistII:TheOtherSide,filmedin1985andreleasedin1986,itexplainshercharacter'sabsencebystatingthatshehasgoneofftoattendcollege.PosthumousreleasesandunfinishedprojectsDunneappearedposthumouslyintheHillStreetBluesepisode,"RequiemForaHairbag,”whichairedonNovember18,1982,onlytwoweeksafterherdeath.Intheepisode,sheplayedateenagemotherwhowasavictimofparentalabuseandchosetogiveherbabyupforadoption,outoffearofrepeatingthecycleofabusethatsheenduredwithherparents;duetoanaltercationwithJohnSweeney,herabusivepartner,herbruisesonscreenwerenatural.TheepisodeairedonNovember18,1982,12daysafterherfuneral,anditwasdedicatedtohermemory.DunnewascastintheminiseriesVin1982;shediedduringfilming,soherrolewasportrayedbyactressBlairTefkin.AccordingtoseriescreatorKennethJohnson,recoveredfootageofDunnewasusedinacameoappearance.Theserieswasreleasedin1983,andisdedicatedtohermemory.RelationshipwithJohnSweeneyDunnemetJohnThomasSweeney,asous-chefattherestaurantMaMaison,atapartyin1981.Afterafewweeksofdating,theymovedintoaone-bedroomhousetogetheronRangelyAvenueinWestHollywood.DuetoSweeney'sjealousyandpossessiveness,however,therelationshipquicklydeteriorated.Thecouplefrequentlyfought,andSweeneybegantophysicallyabuseDunne.Accordingtooneaccount,duringanargumentonAugust27,1982,heyankedhandfulsofherhairoutbytheroots.Frightened,Dunnefledtohermother'shouse,whereSweeneyshowedupandbegantobangonthedoorandwindows,demandingtobeletin.Dunne'smothertoldhimtoleaveandthreatenedtocallthepolice.Afewdayslater,DunnereturnedtothehomewhichshesharedwithSweeney,andthetworesumedtheirrelationship.DuringanotherargumentattheirhomeonSeptember26,1982,SweeneygrabbedDunnebythethroat,threwheronthefloor,andbegantostrangleher.Afriendwhowasstayingwiththecoupleatthetimeheard"loudgaggingsounds"andranintotheroomwhereDunnewasbeingphysicallyattacked.DunnetoldthefriendthatSweeneyhadtriedtokillher,butSweeneydeniedtheclaimandaskedDunnetocomebacktobed.Shepretendedthatshewasgoingtocomplywithhisrequestbutshesnuckoutofthebathroomwindow.WhenSweeneyheardDunnestarttheengineofhercar,heranoutandjumpedonthehoodofthecar.DunnestoppedthecarlongenoughforSweeneytojumpoffthehoodandthenshedroveaway.Forthenextfewdays,shestayedwithhermotherandshealsostayedatthehomesofherfriends.ShelatercalledSweeneyandendedtherelationship.Afterhemovedout,shehadthelockschangedandmovedbackintotheRangelyAvenuehome.DeathOnOctober30,1982,afewweeksafterSweeneyandDunnebrokeup,DunnewasatherWestHollywoodhomerehearsingfortheminiseriesVwithactorDavidPacker.Whileshewasspeakingtoafemalefriendonthephone,Sweeneyhadtheoperatorbreakintotheconversation.Dunnetoldherfriend,"OhGod,it'sSweeney.Letmegethimoffthephone."Tenminuteslater,however,SweeneyshowedupatDunne'shome.Afterspeakingtohimthroughthelockeddoor,Dunneagreedtospeaktohimontheporch,whilePackerremainedinside.Outside,thetwobegantoargue.Later,Packersaidthatheheardsmackingsounds,twoscreams,andathud.Concerned,hecalledpolice,buthewasinformedthatDunne'shomewasoutoftheirjurisdiction.Packerthenphonedafriendandtoldhimthatifhewasfounddead,JohnSweeneywashiskiller.Packerleftthehomethroughthebackentrance,approachedthedriveway,andsawSweeneyinsomenearbybushes,kneelingoverDunne.SweeneytoldPackertocallthepolice.Whenpolicearrived,Sweeneymettheminthedriveway,withhishandsintheairandstated,"Ikilledmygirlfriend,andItriedtokillmyself."SweeneylatertestifiedthatheandDunnehadargued,buthecouldnotrememberwhathappenedaftertheirexchange.Heclaimedthathecouldonlyrecallbeingontopofher,withhishandsaroundherneck.DunnewastransportedtoCedars-SinaiMedicalCenterinLosAngeles,whereshewasplacedonlifesupport.[26]Sheneverregainedconsciousness.Overthefollowingdays,doctorsperformedbrainscans,whichrevealedthatduetooxygendeprivation,shehadnobrainactivity.OnNovember4,herparentsconsentedtohaveherremovedfromlifesupport.Attherequestofhermother,Dunne'skidneysandheartweredonatedtotransplantrecipients.HerfuneralwasheldonNovember6attheChurchoftheGoodShepherdinBeverlyHills.Hergodfather,MartinManulis,deliveredtheeulogy.ShewasburiedinWestwoodVillageMemorialParkCemetery.OnthenightofDunne'sattack,respondingofficersfoundSweeneystandingbyDunne'sunconsciousbodyinherdriveway.AspokesmanfortheWestHollywoodsherifflatertoldreportersthatSweeneytoldofficers,"Ikilledmygirlfriend.”Hewasimmediatelyarrestedandchargedwithattemptedmurder.ThosechargesweredroppedafterDunne'sdeath,however,andsubsequently,Sweeneywaschargedwithfirst-degreemurder,towhichhepleadednotguilty.Sweeneywaslaterchargedwithassaultwithintenttodogreatbodilyharmwhen,duringapreliminarytrialhearing,headmittedthatheandDunnehadaphysicalaltercationonSeptember26,1982,thedaybeforeshefilmedtheHillStreetBluesepisode,inwhichsheappearedwithvisiblebruisesonherfaceandbody.HedeniedassaultingDunne,however,claimingthatsheaccidentallyincurredthebruiseswhenhetriedtopreventherfromleavingtheirhome.TrialofSweeneyBeginningofthetrialandargumentsSweeney'strialbeganinAugust1983anditwaspresidedoverbyJudgeBurtonS.Katz.Duringthetrial,Sweeneytookthestandinhisowndefense.HetestifiedthathehadnotintendedtoharmDunnethenighthearrivedatherhome.Heclaimedthattheyhadreconciled,thattheywereplanningtomovebackintogether,andthatthetwohaddailydiscussionsaboutgettingmarriedandhavingchildren.OnthenightofOctober30,SweeneysaidthatDunnehadabruptlychangedhermindaboutareconciliation,however,tellinghimthatshehadbeenleadinghimonandlyingtohimaboutgettingbacktogether.Atthatpoint,Sweeneysaidthathe,"explodedandlungedtowardher."SweeneyclaimedtohavenorecollectionofattackingDunneuntilhediscoveredthathewasontopofher,withhishandsaroundherneck.Hethenrealizedthatshewasnotbreathing.Sweeneysaidthatheattemptedtoreviveherbymakingherwalkaround,butshefelldown.HethenattemptedtogiveherCPR,whichcausedDunnetovomit.Sweeneysaidthathealsovomited,ranintoDunne'shouse,andconsumedtwobottlesofpills,inanattempttokillhimself.Hethenreturnedtothedriveway,wherehelaiddownbesideDunne,waitingforthepillstotakeeffect.Sweeney'scourt-appointedattorney,MichaelAdelson,arguedthathisclient'sactionswereneitherpremeditatednorweretheyexecutedwithmalice.Instead,hemaintainedthatSweeney,provokedbyDunne'sallegeddeception,actedinthe"heatofpassion.”Dunne'sfamilydisputedSweeney'sclaimthatshehadreconciledwithhim,however.TheyinsistedthathewenttoDunne'shomeonOctober30inanefforttopersuadehertoreconcileaftershetoldhimthattheirbreakupwaspermanent.TheprosecutionandthepoliceinvestigatorsalsodismissedSweeney'sversionofevents,becausetherewasnophysicalevidencethathehadconsumedpillsinanattempttocommitsuicideatthetimeofhisarrest.Upontheirarrival,thepolicesaidthattheyfoundSweeney'sdemeanortobeboth“calmandcollected".DeputyFrankDeMilio,thefirstofficertoarriveonthescene,testifiedthatSweeneytoldhim,"Man,Iblewit.Ikilledher.Ididn'tthinkIchokedherthathard,butIdon'tknow,Ijustkeptonchokingher.Ijustlostmytemperandblewitagain."ThemedicalexaminerwhoperformedDunne'sautopsydeterminedthatthevictimhadbeenstrangledforatleastthreeminutes.Giventheresultsoftheautopsy,thepoliceandprosecutorsdismissedthedefense'sargumentthatSweeneyactedunconsciously,however,becausetheyconcludedthat,inthethreeminutesinwhichSweeneystrangledthevictim,hehadampleopportunitiestoregaincontrolofhisactions,whichmighthavesavedDunne'slife.ToestablishahistoryofSweeney'sviolentbehavior,theprosecutioncalledoneofSweeney'sex-girlfriends,LillianPierce,andaskedhertotestify.Pierce,who,attherequestofSweeney'sattorney,didnottestifyinthejury'spresence,statedthatsheandSweeneyhaddatedonandofffrom1977to1980.Pierceclaimedthatduringtherelationship,Sweeneyhadassaultedherontenseparateoccasions,andasaresult,shewashospitalizedtwicefortheinjurieswhichshesustained.Duringoneoftheassaults,Piercesustainedaperforatedeardrumandacollapsedlung.Shelatersustainedabrokennose.DuringPierce'stestimony,Sweeneybecameenraged,jumpedupfromhisseat,andrantowardsthedoorleadingtothejudge'schambers.Hewassubduedbytwobailiffsandfourarmedguards.Sweeneywasthenhandcuffedtohischairandbegantocry.Heapologizedtothecourtfortheoutburst,whichJudgeKatzaccepted.[35]AttorneyMichaelAdelsonrequestedthatJudgeKatzrulePierce'stestimonyinadmissible,becauseitwas"prejudicial.”JudgeKatzgrantedtherequest,andthejuryonlylearnedaboutPierce'stestimonyafterthetrial.KatzalsorefusedtoallowtestimonyfromDunne'smother,EllenDunne,aswellasDunne'sfriends,citingtheirstatementsaboutSweeney'sabusivenatureashearsay.OnAugust29,defenseattorneyMichaelAdelsonalsorequestedthatJudgeKatzrulethatthecourtlackedsufficientevidencetotrySweeneyonthechargeoffirst-degreemurder,becausepredeterminationwasnotestablished.JudgeKatzgrantedtherequest,andassuch,thejurorswereinstructedtoconsiderthechargesofmanslaughterorsecond-degreemurder.DeputyDistrictAttorneyStevenBarshoplatersaidthatthisdecision,alongwithJudgeKatz'spreviousrulingsbarringthetestimoniesofbothSweeney'sex-girlfriendandDunne'smotherandfriends,seriouslyunderminedtheprosecution'scaseagainstSweeney.VerdictandsentencingOnSeptember21,1983,aftereightdaysofdeliberation,thejuryacquittedJohnSweeneyofsecond-degreemurderbutfoundhimguiltyofthelesserchargeofvoluntarymanslaughter.HewasalsoconvictedofmisdemeanorassaultforthealtercationwithDunnethatoccurredonSeptember26,1982.Dunne'sfamilywasoutragedbytheverdict,callingitan"injustice".AfterJudgeKatzexcusedthejuryandcommentedonthejudicialsystembeingupheld,DominickDunne,thevictim'sfather,yelled,"Notforourfamily,JudgeKatz!"Beforeheleftthecourtroom,DominickDunneaccusedJudgeKatzofpurposelywithholdingSweeney'sex-girlfriend'stestimonyfromthejury,whichwouldhaveestablishedhisviolenthistorywithwomen.VictimsforVictims,avictims'rightsgroupwhichwasfoundedbyactressTheresaSaldana,protestedagainsttheverdictbystagingamarchoutsidethecourthouse.Afterward,severalmediaoutletsalsodebatedtheeventsofthetrialandtheverdict.SeveraloutletscriticizedJudgeKatz'srulings,whichmanyarguedwerepreferentialtowardsthedefense.OnelocalLosAngelestelevisionstationpolledviewerswhoratedJudgeKatzthefourthworstjudgeinLosAngelesCounty.OnNovember7,Sweeneywassentencedtosixyearsinprisonformanslaughter,whichwasthemaximumsentencewhichhecouldhavereceived,withanadditionalsixmonthsfortheassaultcharge.AtSweeney'ssentencing,JudgeKatzcriticizedthejury'sverdictofmanslaughter,statingthathefeltthatDunne'sdeathwas"Acase,pureandsimple,ofmurder.Murderwithmalice".Thejury'sforeman,PaulSpeigel,latertoldthemediathatbothheandhisfellowjurorsweresurprisedbyJudgeKatz'scriticismandhecalledhiscomment"acheapshot.”SpeigelfeltthatJudgeKatz'scriticismdidnotstemfromtheirverdictbutfromtheharshcriticismhereceivedafterward.Speigelwentontosaythathadthejurybeenprovidedwiththeopportunitytohearalloftheevidence,itwouldhaveconvictedSweeneyofmurder.AftermathOntheadviceofTinaBrown,DominickDunnekeptajournalthroughoutthetrial.Hisjournalwritingswerelaterpublishedinanarticletitled"Justice:AFather'sAccountoftheTrialofhisDaughter'sKiller,”whichwasfeaturedintheMarch1984issueofVanityFair.Shortlyafterthetrial,JudgeBurtonS.Katz,whopresidedoverthecase,transferredtotheJuvenileCourtinSylmar,LosAngeles.HelateradmittedthatsomeofhiscontroversialrulingsinDunne'scase"pained"him,buthereiteratedhisthoughtthatSweeneyshouldhavebeenconvictedofmurderandgivenalengthiersentence.Ayearafterherdaughter'sdeath,Dominique'smother,Ellen"Lenny"Dunne,foundedJusticeforHomicideVictims,avictim'srightsadvocacygroup.Afterthetrial,JohnSweeneywasincarceratedinamedium-securityprisoninSusanville,California.HewasreleasedonparoleinSeptember1986,afterservingonlythreeyears,sevenmonthsand27daysofhissixandahalfyearsentence.Afterhisrelease,SweeneywashiredasheadchefatanupscalerestaurantinSantaMonica,California.AfterhediscoveredwhereSweeneywasworking,Dunne'sbrother,Griffin,andhermother,Lenny,stoodoutsidetherestaurant,wheretheyhandedflyersouttopatrons,theflyersread,"ThefoodyouwilleattonightwascookedbythehandsthatkilledDominiqueDunne."Sweeneyeventuallyquithisjob,duetotheprotestswhichwerestagedbyDunne'sfamily,andhemovedoutofLosAngeles.Inthemid-1990s,DominickDunnewascontactedbyaFloridaphysicianwhocameacrossanarticlewhichDunnewroteaboutDominique'sdeath.ThedoctorinformedDunnethathisdaughterhadrecentlybecomeengagedtoachefwhowentbythenameofJohnSweeneyandinquiredifthatmanwasthesamemanwhowasresponsibleforDominique'sdeath.ThemanwaslateridentifiedasthesameJohnSweeney,andinanefforttoprotecttheyoungwomanwhowasnowengagedtoJohnSweeney,Dunne'sbrother,Griffin,contactedthewomanandaskedhertoreconsiderherdecision.Subsequently,SweeneyaccusedtheDunnesofharassinghim,andinanefforttoavoidfurtheraltercations,hechangedhisname.InlaterinterviewsinwhichDominickDunnediscussedhisdaughter'smurder,thewritersharedthat,foratime,heemployedtheservicesofprivateinvestigatorAnthonyPellicanoandaskedhimtofollowSweeneyandreportonhisactionsandwhereabouts.AccordingtoDunne'sfather,PellicanoreportedthatSweeneyhadmovedtothePacificNorthwest,assumedthenameJohnMaura,andcontinuedtoworkasachef.Later,Dunne'sfathersaidthathedecidedthathenolongerwishedtosquanderhislifebyfollowingSweeney,andasaresultofhisdecision,hediscontinuedallofhisattemptstomaintainhisknowledgeofSweeney'swhereabouts.
